CANTON — Three years after a drunk driver killed a Gouverneur teenager, the victim’s father is suing the Palms Restaurant for overserving alcohol.
Jesse J. McEathron, 18, was driving on Route 58 near Country Club Road in Gouverneur when he collided with a vehicle operated by Robin Fowler. Police said Mr. Fowler’s blood-alcohol content tested at 0.24 percent — three times the legal limit.
Mr. Fowler was convicted of second-degree vehicular manslaughter in December 2009 and sentenced to one to three years in state prison. In January, he was released on parole. According to Times reports, Mr. Fowler had a previous conviction for driving while intoxicated from 2007.
According to the lawsuit filed March 22 in state Supreme Court by Mr. McEathron’s father, Herbert McEathron Jr., employees of the Palms continued to serve Mr. Fowler alcohol when they knew or should have known he was intoxicated.
It accuses the restaurant owner, Michelle Pistolesi, of not having policies in place on how to serve alcoholic beverages.
Mr. McEathron is seeking a money judgment for pain and suffering and medical expenses.
He is seeking damages on behalf of his son for loss of future inheritance, loss of parental guidance and nurturing, and permanent and disabling injuries that led to his death.
He is represented by attorney Henry Leader, Gouverneur.
